## Where is Lindsay Clancy now?

Clancy remains at Tewksbury Hospital in Massachusetts, where she continues to receive medical and psychiatric treatment while she is in state custody.

## Where is Lindsay Clancy being kept?

Clancy is being held at **Tewksbury Hospital**, not in a conventional state prison. 

The distinction matters. Tewksbury is a state-operated hospital where she can receive psychiatric and medical care, but her presence there does not mean she is free to leave. She remains in state custody on the pending criminal charges.

## Can Lindsay Clancy still be found not guilty?

Yes. The judge's October 1 ruling did **not** find Clancy guilty. It only rejected the defense's request for the judge to enter a not-guilty finding based on the evidence presented at the first trial. 

If there is another trial, a jury could still return a not-guilty verdict. It could also find her not guilty by reason of a lack of criminal responsibility. 

**How Massachusetts law works**When lack of criminal responsibility is properly raised, the Commonwealth must prove beyond a reasonable doubt that the defendant was criminally responsible at the time of the alleged crime. A defendant is not required to prove criminal responsibility was absent. 

Massachusetts law generally considers whether a mental disease or defect left a defendant without substantial capacity to understand the wrongfulness of the conduct or to conform that conduct to the law. 

That question was at the center of Clancy's first trial. Her lawyers argued that postpartum psychosis prevented her from being criminally responsible, while prosecutors presented evidence they said showed she understood her actions. 

The first jury never reached the unanimous decision required for a verdict. 

## Would a not-guilty verdict mean Lindsay Clancy goes home?

Not necessarily. 

If Clancy were found not guilty by reason of lack of criminal responsibility, Massachusetts authorities could ask the court to commit her to a mental health facility. 

Under state law, a court may order continued hospitalization if it finds that a person remains mentally ill and that release would create a substantial risk of serious harm. Those commitment orders can be reviewed and renewed.

Judge Sullivan declared a mistrial on September 4\. Post-trial reporting indicated that 11 jurors favored a verdict based on lack of criminal responsibility while one juror disagreed, although no unanimous verdict was ever returned by the court. 

That distinction is important: the mistrial means the first jury decided neither guilt nor innocence.
